(sorry that I said federal tax rate is higher for nonresident aliens) However there is a big difference if you're married. (Don't read further if you are single :) ) in 1040NR tax table, there are only 3 categories, [single] [qualifying widower] and [married filing separately] Note that there is no "married filing jointly" category in 1040NR. Although you're a married person, you cannot file "jointly" if you use 1040NR. So you'll end up using [married filing separately] column for your tax. For example, let's say if your taxable income is $50,000. and you are a married nonresident. If you file 1040NR, your tax is $11,157 (22.3%) However, if you file 1040, your tax is only $8,307(16.6%) because you qualify to use [married filing joinly] column in 1040. (This is why I said federal tax rate is higher for nonresident alients in my previous posting. The difference comes from using different categories) To Mr.Shim, If you have been in US more than 5 yrs and you plan to continue to live here, I'd advise you to file 1040. it would be safer to follow what you've found reading publications.
