>Trying to apply a company to get a job in US, I received above message. >I am curious to know what the status of H-1B visa of US is. I'd like >to know whether the H-1B visa quota of this year has filled or not. If >you have any related information about h-1b status, please let me know. If you are not a US citizen nor you don't have a green card, you need to obtain H1B visa to be an employee in a US company. Once you get H1B, H4 will be automatically granted to your dependents (your spouse and children). US government regulates number of H1 visa issues per year. It used to be 65,000 per year or something. If the quota is filled, you have to wait until next quota starts. As I remember, it starts on 1 October every year. There has been a petition to increase the quotas to 115,000 (though I can be wrong, that was the number I remember) - what I heard was US needs more imports of high tech human power. I don't know whether it's been approved or not. The visa can be issued under sponsorship of employer. Employer is supposed to sign up the petition for work permission is US. One of items in petition will be that the employer will immediately send you back to your home when it fires you. To be fair to you, US government also prepared an obligation of employer that the employer should buy a flight ticket for you if you are not able to obtain it by yourself. Once you get H1B, you will hardly have a right but a bunch of obligations. Of course, you have to pay taxes. The company can discontinue the employment at any time if it wants to do. Then, at the same time, your visa expires and you have to pack and go back to home. The visa will designate your employer's name on it. It does mean you can't change your employer at your will. If you dare to do that, your visa will be voided at the same time and your status turns to illegal. Simply speaking, the status of a H1B holder is very similar to that of a slave. So, before you sign on the offer, it's better to have your company promises to sponsor you for the green card very soon, if you are going to work for the company for a long time (more than 3 years.) j P.S. This is not a legal advice. I am not an attorney. For more info, I'd like to recommend you to check alt.visa.us ---------- 그리고 비자에 관한 내용은 http://www.ins.usdoj.gov/에서 조금 찾을 수 있는 것 같더군요. |
