H1 is a Dual-status visa, which means there is no problem with people with H1-B to apply for GC. However, F1 is not. If you do not plan to travel outside the US, you do not have any problem. But if you do, and if you changed your status to F1, you have to get a new visa stamp from US Consulate or Embassy, probably in Korea. (You can get a new H or O stamps in Canada or Mexico, but not F stamps). At this point, US consulate will ask you if you have applied for a GC and you have to write YES (they will check for this anyway), and they will deny your application. Seems like you are in a complex situation.... |
