I don't think it means that you have to use non-NR forms after five years. also, i saw people filed 8843 (*** with medical conditions) with 1040NR. however, why is this filing necessary? i never filed this form for five years. even though my return has been "audited" twice, they never asked me to file form 8843. is there any advantage for us to file form 8843 with 1040NR? i have seen people receive more than $2000 refund from IRS for some reasons, which i can never understand. assume average income as a graduate student is $1200/month, then it's about 14K/year. the maximum tax a student can pay is about $2000. how can a student get a full refund with only $2000 treaty-exempted and some personal deductions? is it due to form 8843? or is there something else that we can claim more tax deductions? as a foreign student, we are not qualified for education credit either. with children, the story is totally different. but i'm saying about a single foreign student. ----------- *Excellence, the goal we may achieve after the death. *Genius, the perfection we may want to be always.
