TRAVELING OUT OF THE COUNTRY A) WHAT YOU NEED TO RETURN TO THE US i) REQUIRED DOCUMENTS If you want to leave the country for vacation and then return to the US, you need: - a valid passport - a valid I-20 or IAP-66 with a signature from the foreign student advisor which is less than 6 months old - a valid visa (except for "contiguous territory" - see below) (Note that students who are on authorized practical training post-completion of their studies will also need a valid EAD card) "Contiguous Territory": If you are traveling to Canada, Mexico, or one of the islands off the US other than Cuba (this is called "contiguous territory") for less than 30 days, you can return to the US using an expired US entry visa of any type as long as you have a valid passport, I-94 and signed I-20 as specified above. (Note: This does not apply to residents of Mexico or the islands who are returning to their home countries.) ii) GETTING A NEW US ENTRY VISA If you are not traveling to "contiguous territory" and your visa has expired, you will need to plan for enough time in the country you are visiting to apply for an entry visa to return to the US. Once again, you cannot obtain a US visa from within the US. NOTE THAT RECENT LAWS HAVE MADE IT MORE DIFFICULT TO OBTAIN A US VISA FROM A CONSULATE WHICH IS IN A COUNTRY WHICH IS NOT YOUR HOME COUNTRY, SO YOU MAY WANT TO CHECK WITH OIE BEFORE PLANNING YOUR TRIP (SEE SECTION 4.D) BELOW). iii) ADDITIONAL DOCUMENTS RECOMMENDED FOR VISITS TO THE US CONSULATE While the documents listed above are all that are strictly REQUIRED to return to the US, if you are required to go to the US consulate while out of the US, you will want to bring additional proof of financial support (if you are supported by your department, bring a letter from them describing the amount of the support). In addition, you may want to bring an official letter of attendance from the HUB and/or a recent transcript to have additional proof of your continued student status. If you are traveling to a country which is NOT your home country, it is even more critical to to have this additional documentation with you. Even with this information, the consulate may still refuse to issue you the visa and may ask you to return to your home country to apply (see Section 4.D) below). |
